Terms of Service

1. Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Hopeful Hearts ("we," "us" or "our"), concerning your access to and use of the Hopeful Hearts application as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site").

You agree that by accessing the Site, you have read, understood, and agree to be bound by all of these Terms of Service. If you do not agree with all of these Terms of Service, then you are expressly prohibited from using the Site and you must discontinue use immediately.

2. Platform Usage Terms

Hopeful Hearts grants you a revocable, non-exclusive, non-transferable, limited right to install and use the application strictly in accordance with the terms and conditions of this license, the usage rules and any service agreement associated with your compatible device.

• You shall not decompile, reverse engineer, disassemble, attempt to derive the source code of, or decrypt the application.
• You shall not make any modification, adaptation, improvement, enhancement, translation, or derivative work from the application.
• You shall not violate any applicable laws, rules, or regulations in connection with your access or use of the application.

3. Payment Terms and Refunds

For organizations utilizing our recurring payment functionality for sponsorships:

• All payments are processed securely via Stripe.
• Recurring payments will automatically be charged to the sponsor's designated payment method on the agreed-upon schedule (monthly or yearly).
• Sponsors may cancel their recurring payments at any time through the Donor Portal.
• Refund policies are determined by the individual charitable organization utilizing the Hopeful Hearts platform. Hopeful Hearts itself does not issue refunds for donations made to third-party charities through our platform.

4. Data Ownership and Responsibilities

You retain full ownership of all data, including orphan profiles, sponsor information, and financial records, that you upload or input into the Hopeful Hearts platform. We claim no intellectual property rights over the material you provide to the service.

You are responsible for ensuring you have the necessary rights, consents, and permissions to upload and process this data, particularly concerning the sensitive data of minors (orphans). You agree to comply with all applicable child protection and data privacy laws in your jurisdiction.

5. Service Level Commitments

We strive to ensure the Hopeful Hearts platform is available 99.9% of the time. However, we do not guarantee that the platform will always be safe, secure, or error-free, or that it will function without disruptions, delays, or imperfections.

6. Limitation of Liability

In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the site, even if we have been advised of the possibility of such damages.
